Special Events Deliveries
III. Mandalay Flowers may set different terms and conditions in relation to special occasions. These include, but are not limited to, Valentine's Day, Pesach, Mother's Day, Rosh Hashana and Christmas.
IV. Terms and Conditions in relation to special events will be updated on our website from time to time without notice and will be effective immediately.

Delivery Timing & Proof of Delivery
I. Mandalay Flowers does not provide a track and trace service nor guarantee an exact time of delivery.

II. Proof of Delivery is available up to one month after delivery of the order.

What happens if no one is at home/work/been discharged from hospital?
I. For Residential addresses, if a courier deems a delivery location unsafe, the order will be returned to dispatch and redelivery fees will apply.
II. For business, school and hospital addresses, Mandalay Flowers accepts no responsibility for delivered items that are redirected to the mailroom, front desk or reception.

3. CUSTOMER OBLIGATIONS
Delivery and contact details
I. It is the customer's responsibility to provide Mandalay Flowers with current and correct delivery address, email address and contact details.
II. Mandalay Flowers accepts no liability where incorrect, incomplete or superseded details have been provided by the customer.

Recipient Details and Personalised Messages
I. The customer must ensure that the recipient details, including spelling, are correct. Mandalay Flowers accepts no responsibility for any incorrect information, when such information results from a reliance on information provided by the customer.
II. In regards to internet orders, customers should ensure that their personalised message is written to their satisfaction. Mandalay Flowers accepts no responsibility for incorrect spelling, grammar or formatting.

4. ALTERATIONS AND AMENDMENTS TO ORDERS
I. We are unable to provide any alterations or amendments (including cancellations) for orders that are in the process of being prepared, already prepared and/or in transit. Notice must be no later than 24 hours advance of delivery date.
II Mandalay Flowers agrees to accept the alteration or amendment request, the Customer must pay for any additional fees and charges incurred.
III. No cash or credit refunds will be made for alterations or amendments that result in a value less than the original order cost.
IV. Mandalay Flowers reserves the right to refuse alterations and amendments.
Mandalay Flowers Floral Deliveries
I. Alterations and amendments (excluding cancellations) must be requested before 1.00pm (EST Sydney Time), the day before the set delivery date.

Alterations and Amendments Disclaimer: during Special Events, including but not limited to, Valentine's Day, Pesach, Mother's Day, Rosh Hashana and Christmas deliveries, all orders are final and Mandalay Flowers reserves the right to not accept any alterations, amendments or cancellations of already placed orders.

5. CANCELLATION OF ORDERS
I. At its discretion, Mandalay Flowers will accept cancellation requests received with a minimum of 1 business day prior to the scheduled delivery date.  Refunds will be made by EFT to the customer's bank account as advised by the customer.   Where the order entails special requests, a cancellation fee may be charged at the discretion of Mandalay Flowers.

Alternatively, a customer may opt for a gift voucher to the full value of the order if they wish to avoid cancellation fees. Please contact us on +612 9362 5000 to discuss your options.
II. Cancellations received after the applicable period stated above, are void.
III. If the cancellation is authorised the difference will be refunded, within 5 – 7 working days, or at the discretion of the customer's bank/financial institution.
IV. Mandalay Flowers is unable to cancel orders that are already prepared and/or are with a courier for delivery.

6. COMPLAINT POLICIES
Any dissatisfaction with an order must be communicated to Mandalay Flowers within 48 hours of delivery either by phone or email. We reserve the right to request photos of the original product(s) and return of the supplied order.

8. PRODUCT RANGE
Availability Substitution and Seasonal Availability Disclaimer
I. Mandalay Flowers endeavours to fulfil orders in compliance with product descriptions, however orders may be subject to seasonal and product availability.
II. Mandalay Flowers reserves the right to substitute products and items when necessary. Utmost care is taken to ensure the final product is as similar in quality to the requested item. Substitutions and alterations to the style of a product will be of similar quality and value.
Photography and Products
I. For photographic purposes vessels and other props may be used for display purposes and are not included with the final product. The itemised product description available on the product page outlines the contents of final products.

9. PRICING AND TRANSACTIONS
I. All prices quoted, unless otherwise stated, are inclusive of GST.
II. All prices, unless otherwise stated, are quoted in Australian dollars (AUD).
III. Product prices do not include delivery fees.

11. GIFT VOUCHERS
I. The voucher is redeemable by the bearer for Mandalay Flowers merchandise to the value stated on the front of the voucher.
II. The voucher may not be used after the expiry date as stated on the certificate and is not exchangeable, refundable, replaceable or redeemable for cash, payment of accounts or other gift vouchers or discounts.
III. A minimum purchase value as stated on the gift voucher is applicable. The minimum purchase value is exclusive of delivery fees.
IV. Limit of one voucher per order applies.
V. Mandalay Flowers is not responsible or liable for vouchers that are lost or stolen.
VI. Gift voucher may only be redeemed either by website or in store (Double Bay).
VII. Partial deductions in the value of a gift voucher are allowed and a record of the remaining value will be kept by Mandalay Flowers. There are no re-issues of the deducted gift certificate value.
VIII. Mandalay Flowers will not redeem a voucher if our records indicate that it has already been redeemed or has not been issued.
XI.The value of this certificate can only be applied to orders over $50 and cannot be applied after your transaction has already been processed and completed. If forgotten, the voucher must be saved and used towards your next purchase.

12. SECURITY AND PRIVACY
Collection and Use of Information
I. Mandalay Flowers retains personal data for the purpose of fulfilling orders for products or services, or for any other such purpose which requires personal data in order for Mandalay Flowers to fulfil an obligation.
II. Personal data includes, but is not limited to: the full name of the customer and/or recipient, payment details, email address, recipient address and contact phone numbers.
III. Mandalay Flowers does not keep records of customer credit card details.
IV. For customer security, your IP address may be logged and recorded with your purchase details.
Disclosure of Information
I. Mandalay Flowers may disclose personal data necessary to third party service providers for the purpose of fulfilling customer orders and any other obligations.
II. Mandalay Flowers will not disclose personal information to third parties for marketing purposes without prior authorisation.
III. Under no circumstances will Mandalay Flowers sell or receive payments or services for disclosing customer personal information to any partner or external company.
Sender Anonymity and Disclosure
I. Customers have the right to remain anonymous except in circumstances where personal information is required to complete an electronic transaction.
II. If requested prior to ordering, Mandalay Flowers will not disclose sender/customer information to a recipient.
Information Storage
I. Mandalay Flowers website may utilise cookies to store information of browsing history and to enable browsing features. We do not store any personal or financial information about customer-used cookies.
Promotional Material
I. Customers can elect to receive promotional material by joining as a Member and opting to receive plain text or HTML emails.
II. In compliance with Australian law, all marketing material sent to the subscriber will include an option for the subscriber to request removal from mailing or contact lists for any future marketing.

14. GOVERNING LAW
I. The use of this website and these conditions is governed by and construed in accordance with the laws of Australia.
II. Any legal action arising out of its use shall be brought and enforced under the applicable Australian law.
III. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia.

15. THIRD PARTY SITES
I. The website operated by Mandalay Flowers may provide links to related third party sites. Mandalay Flowers is not responsible for the privacy practices or the content of such websites and does not warrant the security of any information supplied to third party sites.

16. TRADEMARKS, COPYRIGHTS AND RESTRICTIONS
I. All material on websites owned, operated, licensed or controlled by Mandalay Flowers, including but not limited to images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by Mandalay Flowers its related companies or by other parties that have licensed their material to Mandalay Flowers.
II. Material on any website owned, operated, licensed or controlled by Mandalay Flowers is solely for your personal, non-commercial use. Such material may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of Mandalay Flowers.
III. Use of the materials on any other website or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use is a violation of Mandalay Flowers' copyrights, trademarks and proprietary rights and is prohibited.

18. FORCE MAJEURE
I. Mandalay Flowers is not liable for failure to perform obligations, including but not limited to, the fulfilment of an order or a delivery, if such failure occurs as a result of acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster) war, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power, terrorist activities, government sanction, blockage, embargo, labour dispute, strike, theft, lockout or interruption or failure of electricity or telephone service or any other event or phenomenon beyond Mandalay Flowers' control.
